Vick 'has real legal problems'

Those who believe or hope that Michael Vick’s legal problems will be plea-bargained or argued away or even that it will take a year or more for the case to come to trial won’t want to read this, but it’s something they and everyone else interested in the case ought to know.

This isn’t something that’ s going to go away. What’s more, the prosecutors who brought the charges are known for moving trials ahead quickly; a trial could start before the NFL season is more than a week or two old. The odds of conviction are very high.

This comes to me courtesy of my friend Michael Gilberti, a former assistant U.S. District Attorney who is now a defense attorney in Red Bank, N.J.

With some edits for length, here’s the e-mail he sent me this morning:

"If you have not seen the text of the indictment, you can see it at thesmokinggun.com. As a former prosecutor and present defense attorney, I can safely say that Michael Vick a/k/a "Ookie" has real legal problems. It appears from the text of the indictment that there are at least two cooperating witnesses ("scumbag cooperators") who had direct dealings with him. At least one of them is a person whose dogs fought Vick’s dogs, and my guess is that it is someone who has "flipped" and, in defense parlance, is "singing for his supper." While defense lawyers love to yell about that, if the government has any corroboration for the person’s story (e.g., photos, receipts, consensual body wires or phone taps), the defense can yell all it wants, but a jury will most likely believe the scumbag cooperator. If there are two cooperators who corroborate each other, the chances of being acquitted go down dramatically, especially if there is similar corroboration for the second cooperator.

"Several other points: The Eastern District of Virginia is known as "the Rocket Docket" because . . . it moves cases quickly. Initially, at arraignment, the Court will set a trial date within 70 days of the arraignment date . . .

"While it has been correctly said that you can indict a ham sandwich . . .

in most jurisdictions (and unlike the Duke lacrosse case), the U.S. Attorney will not indict a case unless the government has evidence sufficient to convict the defendant. The vast majority of federal cases end in conviction.

. . Also you have to consider that the government has the advantage of conducting, and the resources to conduct, as much investigation as is necessary to get the evidence to support a conviction and can control the timing (within the five-year statute of limitation). This is especially true in a high visibility case, like this one, in a tough District like the Eastern District of Virginia. In short: the government holds most, if not all, of the cards.

"Assuming that the government has the evidence to prove most of the facts stated in the indictment, I believe that Vick has serious problems. And it is entirely possible that, if he does not negotiate a guilty plea, he will be found guilty (barring jury nullification)."

Mike Vick has thrown his last pass in the NFL.  He has been indicted and will face a federal court that convicts 80% of all cases.  The federal court has already been selected, which is known for being swift and assured of its decisions.  Vick operated a dogfighting/gambling operation and has two main players ready to testify against him in a court of law.  At this point, the odds seem favorable that he will spend the maximum six years in prison for his involvement with an animal cruelty and illegal gambling operation.  The feds mean business when they come knocking on your door.
It's time for the League, the Owners, and the players to do the right thing; Vick should be banned for life.

Each day that the sun comes up and this does not happen it shows more and more what we, as fans, are made of, and what the aforementioned parties think we will put up with.

If the NFL will not sack Vick, then maybe it's time we fans sacked the NFL.

Okay Vick go to jail now are you people so stupid that you think this is going to stop dog fighting? It's just like busting a couple drug dealers it want go away people and if Vick was a professional we would not even be talking about this case.  This world is so messed up. No, I am not saying that it's okay to mistreat animal but lets be real what will it solve in the long view of things.  This dog fighting issues is much bigger than Vick just like racism is bigger than Imus. They both are just token to side step whats really going on.
I own an American Staffordshire Terrier (Pitbull) and the fact that these are one of the most affectionate and loyal dogs to their owners makes it even more unimaginable that someone could treat them this way.  The thought of the suffering that these dogs endured makes me sick to my stomach and Vick is lucky he doesn't live near me!  Unfortuately, he will never suffer as his dogs did...which is the saddest part of this.
I cannot believe what this coward has done! He is such a scumbag, he should be arrested for life! What is wrong with people!!!! This man should be killed!!
i think you're innocent until proven guilty but i don't think Vick should be allowed to play on sundays....pay him if the falcons want but let him sit on the bench sundays and deny him the chance to do what he loves best and thats play football...until the legal process plays out. If the Falcons allow him to play, then they don't care about anything but winning and making money and are insentitive to the whole situation and SHAME ON THEM!!!! i also wrote the falcons an email and said just what i wrote here.
Sad, sad, sad....I never cared much for Michael Vick as a quarterback....now this just seals the deal.  You betcha by golly wow he knew..he knew and condoned all that was going on in his home. I too will no longer buy Nike products, nor will I be watching the Atlanta Falcons ...unless they "Just do it."....fire, fine and jail Michael Vick! I don't care if he is black, white, red, pink or whatever...actually I think his color must be yellow...this is just wrong..plain and simple...WRONG!
I am a black woman and a dog lover and these horrific acts have nothing to do with the culprits race.  It has to do with ones humanity, period.  I have adopted dogs rather than see them go to a animal shelter.  It's a lot of work but the reward in love returned and  loyalty and compainionship is worth the time and energy.  I wonder what happened to this young man who had so much going for him.  Such horrors placed upon helpless animals are unthinkable to most people.  Yes, Vick deserves to lose it all.

Michael Vick is a disgrace as a sports figure, role model and as a human being.
The indictment seems like the Feds have a slam dunk case... They dont give people Federal Indictments just for fun they usully have a reason and evidence. The NFL needs to Suspend Vic w/o pay until this is resolved. If all else fails and he is not convicted of dogfighting, the Feds will end up getting him on Tax evasion for not reporting his winnings on the fights
Vick is a MORON - I can't put "Mr." in front of his name.  What is the matter with the NFL?  It is a Federal indictment and he should be suspended.  Vick's disgusting and inhumane behavior should not be tolerated and he should not be on a football field.

I agree with Tony (the defense attorney).  You all are idiots, always ready to jump on a bandwagon without knowing the facts.  I agree athletes have a responsiblilty, but you guys are letting the media manipulate your minds.  You all sound like you don't have lives and need something or someone to condemn.  I'm glad I don't live your perfect worlds.   No mattter what the outcome is, guilty or not, Mike Vick will have more money than you idiots will ever see, because you can swindled into beleiving anything.  What morons! Wish we could open your closets and dodge all of the skeletons that would fall out.    
Amen to all the comments that call for Vick's speedy demise. In a perverse way, he has helped bring the horrific practice of dog fighting, and animal abuse in general,to light. All the dogs who have suffered and died due to dog fighting can at least be avenged by much harsher penaltys and more investigations by law enforcement - if we don't let this issue die. Of course, it's likely that law enforcement is participating and/or benfiting from this practice in some areas. They need to burn with the rest of the sick bleeps that abuse animals.  Write your Senators and Congressmen....Revolt. Thanks to all of you who are doing something to stop animal abuse.
You people are a piece of work!!!! If you were in his position you wouldn't want everyone automatically assuming that you were guilty. He deserves a chance to defend himself. It's funny how we put the life of an animal above that of a human being. I haven't seen any blogs on women or children that have been beated, raped, or murdered by vicious people. We care more about celebrities than anyone else and that's a shame. We have bigger problems going on in the world than Michael Vick. I am a true dog lover and I don't support any cruelty to animals but you all shouldn't be so quick to hang someone out to dry. Anyone can get enough evidence to indict someone and all you need are a couple of lying perps to corroborate a story in order to save their own hides. I love the Falcons and Vick (as I am an Atlanta native) and I'm not going to boycot them. Funny how I don't hear anyone talking about boycotting things that really matter. So before you get on the website and throw your really hateful language at another human being, just remember how you would feel if the shoe was on the other foot. To torture, electrocute, and force animals to fight to death for your enjoyment is a clear and undisputable sign of sadism.  Does the NFl, the Falcons, and Nike really want a cruel sadist as the face of their brand?
People love football, but they love their dog more than they love football.
If the Falcons, Nike and the NFL don't suspend or outright ban this disgusting creature (won't even call him a human) then I will never, ever spend a single dime on the NFL.  And I am a lifetime NFL fan, and USED to love MV.  No longer - no longer!!  To think of the suffering he caused those poor animals makes me physically sick to my stomach.
Get ready for OJ part 2 because he will not be convicted. 1. He will get a dream team of lawyers 2. He will pay people to keep their mouths shut. With a max penalty of 6 years, they will only do 3 or less. For a few million dollars they won't talk. 3. He will cry racism. Somehow, some way, he will make it a black thing and try to be the victim. 4. They will select the most ignorant, football loving, blackest jury have ever seen. He will pay a big fine, but will not see one day of  prison time. He will continue to QB in Atlanta and he will continue to suck as a quarterback.  Just watch.
The NFL and the Falcons need to send a quick and tough message to Mike Vick. Suspend him now and if and when he is cleared of "ALL" charges bring him back. But they need to make statement that this kind of activity will not be taken lightly.

This is my first time writing a comment on a blog. My blood is boiling over this disgusting human being. How can anyone hurt an animal let alone watch two dogs fighting to death. Killing off the ones that they ("don't need) anymore. I will not watch any of the Falcons football games this season and i hope that everyone else out there does the same. I hope that the stadium is empty if that disgusting man plays football. And any company that is affiliated with Vick I will not buy any of their merchandise. The "regular people" in this county have to stand up and say WE ARE NOT GOING TO TAKE THIS FROM THE RICH AND FAMOUS ANYMORE.  If a black man from Buffalo New York was arrested for dogfighting He would be put in jail with out any bail because he cant afford any bail, then sentenced to jail. that is what they should of done with Vick let him spend a month in jail just awaiting trial like most of us have to do if we were ever that studpid like he is. Hang him like he hung the dogs.

Wow man.  Why are you coming down so hard on the Falcons?  If they cut him, doesn't he get to keep his signing bonus?  If he goes to jail, won't he have to pay back the pro-rated amount of that bonus, about $26 million?  It seems cutting him would be rewarding this type of behavior, by letting him keep the money.  One would think you would have thought of this angle, but then again, reading your commentaries, I come to expect.  Hopefully I am right and he has to pay it back and that is what the Falcons are thinking.
The Feds just dont indict willy-nilly. I am sure they have a case. The NFL needs to suspend him until the outcome of the case, this is way more troubling than DUI and drug offenses. The NFL needs to put in their morality clause to all contracts that if you are suspected of being in trouble with the law (other than minor traffic violations like speeding) you are suspended until the outcome. (it could be drugs, DUI, Domestic Violence, or anything) The NFL and all other sports needs a no-nonsense policy that is strictly enforced. These guys no matter how we like it or dont are role models and they need to behave accordingly.

Even if the Feds dont convict him on the Dog fighting issue, they will get him on tax evasion for not reporting his winnings on the fights.... so either way.... Hes done

Vick is a disturbed piece of garbage who is a waste of space and I hope he suffers 100 times more than those poor helpless animals.Does the NFL really want a man like this representing their sport?
the 8 dogs lost and so they went home and had a dog killing party amongst themselves and for the other dogs to watch.  nice.  they could have just shot them- the killings progressed from shooting to hanging then to electrocuting them... but it became worse for those dogs and easier for vick’s crew.  i have to wonder- now that it has unfolded- if Vick really feels bad he did it or if he got caught.
Just listening to the evening news and thought I heard Sen. Byrd (WVA) call for Vick's execution. Guess he is still holding a grudge over the UVA vs. VA Tech game Vick won with the miracle run.
The only team that will Vick is Oakland. I will vote with my dollars and never go to another NFL game if they let a convicted dog killer knowingly play. Al Davis is the only low life owner that would hire Vick.
I agree with a boycott of the Alanta Falcons, and Nike, if both organizations do not take an immediate and strong stand agains Michael Vic. Please Please everyone out there....let's stand together and show that we will not spend our money supporting this type of atrocity.

Dog fighting has been thriving for a long time without much concern of America. Anyone can check with the Humane Society on a rugular basis and see the pit bulls rescued from these vile depraved people. Unfortunately, there are animals electrocuted daily so the vain and repugnant can have the enjoyment and gratifcation of wearing their fur.

I don't , or can not express enough what I would like to do to this person we call a human being. I hope they take his money and give it to dogs abused by him and dogs all over the country.. I usually do not hate, and do not like to, but I hate this guy and all those cowards that do this abuse to dogs. Give them the same treatment and they would cry like babies, because the are low life cowards.

As a volunteer with 4th and 5th graders in a Humane Education pogram which teaches these children Respect, Responsibility, Empathy and Compassion by bringing animals into the classroom; I have seen miracles worked through animals.  You hurt our children Michael; a world of children has been damaged as badly as your dogs.  Children imitate what they see. If you have an ounce of dignity or class; you will stay AWAY from society one way or the other and ponder the lives that you chose to take with the VERY dark side of your soul.
There are people in this world who eat dogs. A dog would eat a dog, too... and without thinking twice So, for goodness sake, all you human haters should just get over yourselves.

Convict Vic and send him to a prison with the worst gang problems, so he can find out what it's like to have to fight for his life. His dogs know what I'm talking about.
I am so tired of superstars getting away with MURDER I'm not even sure if I believe in our justice system any more. This man deserves to be treated like a murderer, he should spend the rest of his life in prison. Animals give such unconditional love even when you abuse them and for him to do this to one of Gods' creatures is unforgivable. I pray there is justice for this speck of dirt.
